陈丹虹律师 陈丹虹分析职业移民绿卡申请雇主的资格 陈丹虹 首先介绍简单的背景知识，职业移民分为三个步骤：PERM劳工卡，I-140申请和I-485申请。I-140申请要求申请公司证明有能力支付PERM申请所要求的工资(Ability to Pay)。     陈丹虹指出 公司证明Ability to Pay的方法主要有3个： 1）申请人的工资已经等于或高于申请职位的法定工资。 2）公司的净收入 (Net Income) 高于劳工卡职位的法定工资。 3）公司的净资产 (Net Asset) 高于劳工卡职位的法定工资。 支付能力的证明需要从递交PERM劳工卡的时间开始计算，也就是说，在公司递交劳工卡申请的时候，公司就需要有能力支付申请人的公司。 如果在递交劳工卡申请的时候，申请人在公司任职，并且申请人的工资达到或超过PERM申请的工资水平，申请人的工资年工资单W-2可以用来证明公司的支付能力。比较复杂的情况是在递交PERM申请的一年当中，申请人在公司的工作时间少于一年，或者申请人在一年当中，工资出现变化，这样一来，申请人年终的收入报表W-2有可能就不能够达到PERM劳工卡申请的工资水平。   陈丹虹律师 在这种情况下，申请律师应该向移民局说明，申请人的年工资报表W-2不能反映申请人12月的工资，或者不能够反映申请人在递交PERM申请时的工资。并且提供申请人PERM递交当时和之后的工资单，作为申请人月收入已经达到PERM申请要求之证明。 还有一种情况是公司在申请人加入公司之间就为申请人递交了PERM申请。在这种情况下，申请人的工资单就不能用来完全证明公司的在递交PERM申请时的支付能力。公司需要依靠公司的其它资产或者公司收入报表来证明支付能力。
